While the EPA has not yet provided a definitive timeline for final approval, facilities that have completed their registrations and propose to use the SWG 100 BIO can qualify for provisional approval under the Biogas Regulatory Reform (BRR). This approval is granted on a case-by-case basis, allowing registered facilities to continue operating while waiting for the EPA’s final decision.

Here’s how this works: Facilities using the MRU analyzer, which we’ve submitted under the AMP (JSDEP-23528), can participate in BRR regulations with provisional approval. This provisional status is tied to your facility registration and engineering review—not directly to the equipment itself. This is a major advantage for facilities that want to stay ahead of regulatory demands without delaying their operations.

The Path Forward: No Red Flags So Far

We’re happy to report that in conversations between the EPA and our consultant, no red flags have emerged from the AMP submissions that would suggest a risk of denial. This includes not just biogas applications but also RNG gas analysis, a rapidly growing sector in renewable energy.
